On motion of Legislator Harckham, seconded by Legislator Gelfarb the minutes were approved 4 - 0.

I. ITEMS FOR DISCUSSION
1. ACT-2012-99 : IMA-Prisoner Transportation-Peekskill

An ACT authorizing the County to enter into an Inter-municipal Agreement with the City of Peekskill in order to provide reimbursement for prisoner transportation to the Westchester County Jail.

Ms. Perez introduced the continuing discussion of the IMA's with Yonkers and Peekskill for the transport of prisoners.  Deputy Commissioner Mazzuca of the Dept. Of Corrections, Mr. Sullivan of the County Attorney's Office and Mr. Malandrino representing the PBA joined the discussion.

 

Some issues were brought up last week concerning changes in the contracts affecting how Public Safety officers' arrests were to be transported to the County jail.  Mr. Mazzuca noted that the new contracts had the clause removed that required Public Safety Officers to transport their own prisoners. 

 

The department feels this has no relation to the PERB decision concerning air marshalls tranporting prisoners and noted that it is the Department of Correction's responsibility to transport prisoners to the jail.

 

Mr. Malandrino stated that the police officers believe that part of their job is being taken away. They used to have a transport unit, then that was cut and overtime was used; now even that is too much.  The PBA's attorney's couldn't be here, but are sending a legal opinion.

 

Mr. Harckham asked what the County Attorney's opinion is.

 

At this point, 10:00am,  Mr. Gelfarb made a motion to go into executive session which was seconded by Mr. Harckham.

 

At 10:18am the committee came out of executive session and Ms. Perez announced that they were going to meet again next week and invite the union to come and bring its attorneys and also have the law department and the Corrections department.

An ACT authorizing the County to enter into an Inter-municipal Agreement with the City of Yonkers in order to provide reimbursement for prisoner transportation to the Westchester County Jail.

3. ACT-2012-68 : IMA-For-Hire Vehicles-Rye Brook

An ACT to authorize the County of Westchester to enter into an inter-municipal agreement with the Village of Rye Brook pursuant to which the Village, through its police department, will assist the County in enforcing the Westchester County For-Hire Vehicle Law.

Mr. Ryan wanted to know why the City of White Plains and other communities were not included in the IMA'S. He noted that these make up only a minor piece of the County and these laws should be enforced throughout Westchester County. Ms. Perez responded that these municipalities were the first to show interest; other communities can opt in, in a separate IMA, at a future date.

 

Mr. Ryan requested to be provided with a copy of the letter sent to White Plains that discussed all this and put the responsibility in their hands  or making the decision; what communities have been contacted; what was the nature of the contact; example of the type of communication that has been sent for Scarsdale, Harrison, White Plains.  Other legislators requested Mt. Kisco and Port Chester.

 

Mr. Williams raised the issue of officers from one jurisdiction going into another municipality's jurisdiction in pursuit of enforcing this particular act.

 

Mr. Harckham moved to amend Items 5358, 5359, 5360 and 5361 by adding section 800.02 of the rules and regulations implementing the For-Hire Vehicle Law.  The Chair accepted the amendment.

 

Ms. Marcotte noted that there are issues with these IMA's that haven't been addressed.  The IMA's had been amended to change the termination date to 60 days and language has been added to end the program twelve months after the effective date.  She did not think this was a good idea and wondered why we are going to force all the people involved to come and sign everything again after twelve months.

 

Ms. Marcotte stated that these agreements are a good idea and should continue.  She noted that she believes it is the Chairman's intention to implement this as a pilot program, which is why she is bringing this to everyone's attention. 

 

She then asked why there is no IMA for Greenburgh? 

 

Ms. Perez replied that we haven't received confirmation of a resolution by the town, but once we do they can opt into the program.

 

On motion of Legislator Gelfarb seconded by Legislator Harckham this item was approved  as amended with a vote of 4 to 0.

4. ACT-2012-69 : IMA-For-Hire Vehicles-Sleepy Hollow

An ACT to authorize the County of Westchester to enter into an inter-municipal agreement with the Village of Sleepy Hollow pursuant to which the Village, through its police department, will assist the County in enforcing the Westchester County For-Hire Vehicle Law.

 

On motion of Legislator Gelfarb seconded by Legislator Harckham this item was approved as amended with a vote of 4 to 0.

5. ACT-2012-70 : IMA-For-Hire Vehicles-Tarrytown

An ACT to authorize the County of Westchester to enter into an inter-municipal agreement with the Village of Tarrytown pursuant to which the Village, through its police department, will assist the County in enforcing the Westchester County For-Hire Vehicle Law, Chapter 270 of the Westchester County Administrative Code.

 

On motion of Legislator Gelfarb seconded by Legislator Harckham this item was approved as amended with a vote of 4 to 0.

6. ACT-2012-71 : IMA-For-Hire Vehicles-Tuckahoe

An ACT to authorize the County of Westchester to enter into an inter-municipal agreement with the Village of Tuckahoe pursuant to which the Village, through its police department, will assist the County in enforcing the Westchester County For-Hire Vehicle Law.

 

On motion of Legislator Gelfarb seconded by Legislator Harckham this item was approved  as amended with a vote of 4 to 0.
