With a quorum present, {MinutesOpenedBy} called the meeting to order at {MinutesOpened:h:mm tt}.

 

The Committee on Community Services was called to order at 1:09 PM by Chairwoman Alfreda Williams.

MINUTES APPROVAL
I. ITEMS FOR DISCUSSION
1. 5033 : Reproductive Health Care Facilities Access

A Local Law adding Chapter 425 to the Laws of Westchester County to ensure safe access to reproductive health care facilities. 

This item is joint with the Committee on Community Services.

 

Legislators Shimsky and Myers introduced the new revised bill. 

 

Legislator Smith asked several questions.

 

Legislator Kaplowitz asked for the last version of this bill from the previous term. Committee staff provided the final version of the 2011 legislation. Legislator Kaplowitz went through the differences in the two bills line by line. Legislators Kaplowitz and Gelfarb asked for further meetings with testimony from both sides.  A discussion ensued regarding the bill.

 

A motion was made by Legislator Myers and seconded by Legislator Shimsky for the Committee on Community Services for approval of the item. No vote was taken, a discussion ensued.

 

With a motion by Legislator Shimsky and seconded by Legislator Harckham for the Legislation Committee for approval of the item.  No vote was taken, a discussion ensued.

 

Legislator Kaplowitz made a motion for the Legislation Committee to amend the motion on the table to approve for a public hearing only.  His motion was seconded by Legislator Burrows.  The motion passed with a vote of 5-4, with Legislators Ryan, Williams, Shimsky, and Harckham voting no.

 

Chairwoman Williams asked for a motion and a second to make this amendment for Community Services. Hearing none, no motion was made.

 

Legislator Maisano made a motion to approve of the motion on the floor for the Committee on Legislation to sign the legislation out for public hearing only.  Legislator Burrows seconded the motion.

 

Chairman Ryan called a five minute recess.

 

Chairman Ryan called the meeting back to order at 3:04 pm.

 

With a motion on the floor, Chairman Ryan called for a roll call vote to sign the item out for public hearing only.  The motion failed with a vote of 5-6, with Legislators Ryan, Harckham, Perez, Shimsky, Williams, and Jenkins voting no.

 

With a motion by Legislator Shimsky and seconded by Legislator Harckham for the Legislation Committee the item was approved for all purposes with a vote of 7-3 with Legislator Kaplowitz voting without prejudice, and Legislators Burrows, Gelfarb, and Marcotte voting no.

 

With a motion by Legislator Myers and seconded by Legislator Shimsky for the Community Services Committee the item was approved with a vote of 6-0.

 

With a motion by Legislator Shimsky and seconded by Legislator Myers the Committee on Community Services adjourned.

2. LL-2012-9 : Amendment to the Fair Housing Law

An amendment to the Fair Housing Law of the Westchester County Human Rights Law in order to obtain full certification as substantially equivalent to the federal Fair Housing Act by the  U.S. Department of Housing and Urban Development.

Committee Counsel Matthew Gallagher and Chris Crane provided a brief overview of the new legislation. Mr. Gallagher stated that there are several issues with the regulations and determining probable cause.

 

Legislator Harckham asked that the Human Rights Commission be invited to help explain the Fair Housing Law and the new requirements and how they would work. Chairman Ryan agreed and asked that for the next Committee meeting both the Human Rights Commission and the County Attorney be invited to discuss the legislation and requirements. 

 

Chairman Ryan also asked if there are any fiscal concerns with this new legislation. Mr. Gallagher stated that there is a strong possibility of a fiscal impact that he is concerned about. The Committee agreed that they will also meet with the Budget Committee after working with the Human Rights Commission and the County Attorney  to iron out the fiscal concerns.

Moved by Legislator Harckham seconded by Legislator Perez the Committee on Legislation adjourned at {MinutesClosed:h:mm tt} with a vote of 11-0.
